Terms of Service
These Terms of Service ("Terms") explain the rules for using CultivateSkill (the "Site"), including its safety tests, lessons, and shop evidence tracker. CultivateSkill is an independently built and operated platform, created and run by Matt Schroer ("we," "us"). It is not owned, operated, or controlled by any school or school district. Schools use the Site under authorization from us, and each school is responsible for approving its own staff and students to access it.
1. Agreeing to These Terms
By signing in and clicking "I Agree" on the Site's liability waiver pop-up, you agree to these Terms and to the waiver. The waiver appears before you can use any page. Your acceptance is recorded (your school email, the waiver version, and the date and time). If you click "I Disagree," you can't use the Site.
If we change the waiver wording, everyone will see the pop-up again and must re-accept before continuing. The waiver and these Terms work together. Each one stands on its own if the other is ever found unenforceable.
If you are under 18, your parent or guardian should read these Terms too. Your school's enrollment or permission paperwork may also cover your use of the Site.
2. Who Can Use the Site
- Students and teachers who sign in with a school Google account that has been approved for the Site.
- Your school decides which features (safety tests, lessons, tracker) are turned on for you.
- We may remove or block any account at any time.
3. Learning Tool Only — Not Certification or Permission
The Site is a classroom learning tool. Please understand:
- Passing a test, finishing a lesson, or logging a skill does not certify you to run any tractor, mower, side-by-side, welder, or other equipment.
- It does not replace hands-on training, instructor sign-off, equipment manuals, employer rules, or the law.
- Tests and lessons may be modified from national programs (like NSTMOP) and are not official national certifications unless your teacher tells you so in writing.
- Never operate equipment without proper supervision, training, and permission from your instructor or parent/guardian.
4. Your Account
- Use only your own school account. Don't share it or sign in as someone else.
- Do your own work. Cheating, sharing answers, or getting around retake, timing, or review rules is not allowed.
- Tell your teacher right away if you think someone else has used your account.
5. Acceptable Use
Don't:
- Try to break, hack, scrape, overload, or get around the security of the Site.
- Look at, change, or copy anyone else's information.
- Upload anything unlawful, harmful, harassing, or inappropriate for school, or anything you don't have the right to share.
- Copy, post, sell, or share test questions, answer keys, or lesson materials outside of your class.
- Use the Site for anything other than school-approved learning.
6. Content You Upload
You keep ownership of what you upload (like evidence photos and written answers). By uploading, you give us and your school permission to store, display, and use it to run the Site and for educational and grading purposes. Only upload work that is yours and appropriate for school.
7. Use and Misuse of Information from the Site
This section is important.
- Everything on the Site (test questions, answers, explanations, lessons, scores, and reports) is provided for general educational purposes only.
- You are responsible for how you use any information you get from the Site, including in real-world situations outside of class.
- We are not responsible for injury, damage, loss, or other harm that results from anyone's use, misuse, misunderstanding, or reliance on information from the Site. This includes use by someone other than the person the information was meant for, use outside a supervised class setting, and sharing or reposting of scores, reports, screenshots, or materials.
- Don't rely on the Site as your only source for safety decisions. Follow your instructor, the equipment operator's manual, and applicable laws.
- If you get access to information about another person (for example, by mistake or by an account error), you must not use or share it, and you must report it to your teacher.
8. Assumption of Risk
Agricultural equipment, shop tools, and farm work carry real risks, including serious injury or death. Using the Site does not remove those risks. As stated in the waiver you accepted, you (and your parent/guardian if you are a minor) understand these risks and accept responsibility for your own actions when applying what you learn.
9. Disclaimer of Warranties
The Site is provided "as is" and "as available." To the fullest extent the law allows, we make no promises that the Site or its content will be accurate, complete, current, error-free, uninterrupted, or suited to any particular purpose. Scores and reports may contain errors, and your teacher's records control if there is a difference.
10. Limitation of Liability
To the fullest extent the law allows, we (and anyone who helps run the Site) are not liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or damage connected to use or misuse of the Site or its information. If any liability is found, it is limited to the greatest extent the law permits. Nothing in these Terms limits liability that the law does not allow to be limited.
11. Indemnification
To the extent allowed by law, if you (or, for minors, your parent/guardian) misuse the Site or its information in violation of these Terms and that causes a claim against us, you agree to be responsible for the resulting costs.
12. Privacy
Our Privacy Policy explains what information the Site collects and how it is protected. It is part of these Terms.
13. Changes, Suspension, and Ending Access
- We may update these Terms. When we make a meaningful change, you will be asked to accept it again.
- We may change, pause, or end any part of the Site at any time.
- Misuse of the Site may lead to loss of access and school discipline under your school's policies.
14. Legal Details
- These Terms are governed by Missouri law and applicable federal law. Disputes will be handled in the state or federal courts located in Missouri.
- If any part of these Terms is found unenforceable, the rest stays in effect.
- Not enforcing a rule right away doesn't mean we give up the right to enforce it later.
